Special education teacher accused of aggravated sexual battery with minor

A teacher at the Levy Special Education Center has been arrested for aggravated sexual battery.

Sedgwick County District attorney, Marc Bennett confirmed to Eyewitness News that Tommy Tarrel Rains was arrested in January.

According to Bennett, Rains is alleged to have had sexual contact with someone who is incapable of consent due to mental deficiency.

Right now we don't know if that victim was a student - but we know they were a minor below the age of 16.

Bennett says in his first appearance in court, Rains was charged with two counts of aggravated sexual battery.

Susan Arnesman with Wichita Public Schools says he has been placed on administrative leave. She says the district is cooperating with law enforcement during this investigation.

His preliminary hearing will be January 17.
