Police have arrested and charged an area man with rape and sodomy.Police say the man later admitted to knowing exactly what he was doing. The victim, however, had no idea; she is a mentally handicapped young girl.Police say that the girl knew something bad had happened on Saturday so she told her mother. A police investigation got underway and on Tuesday that man was arrested.According to police, the man says it wasn't a crime, it was consensual.Police classified the victim as "borderline mentally retarded."Neighbor Jerimiah Lamb was sickened to hear of the police report on the 20-year-old suspect, Ivan Garcia. It reads in part, "Juvenile reports violater forced vaginal and anal sex on her, locked her in her bedroom to complete act. Violater is a stranger to juvenile."Bardstown police Capt. Tom Roby says the 16-year-old girl had never met Garcia, he only knew of her through a family friend.The victim understood she had been touched inappropriately and when her mother returned home she told her what had happened.Garcia told investigators a different story. During his interview, he admitted to sexual intercourse with the victim and stated it was consensual.Lamb, who has a family member with Downs syndrome, finds that hard to believe."My cousin can barely consent to the bathroom, let alone anything like that. It's just…just horrible. I'm extremely glad he's not that close to me anymore. Anybody that can do that... I'm glad he's not my neighbor anymore," Lamb said. A rape exam was performed Saturday night on the victim and police say they were able to collect evidence.Garcia told police he used a condom but it broke. Bardstown police are continuing their investigation.Garcia is currently charged with one count of sodomy and one count of rape, and police say more charges are possible.
