November 2009 was a busy month for Appellants' counsel, Robert Nicholson. Mr. Nicholson left his previous law firm, became a Partner at another firm, and celebrated a Thanksgiving holiday, all while advocating for his clients, including Mr. Simon and JAS Partners, Inc. (collectively "Simon and JAS"). In the midst of this flurry of commotion, Mr. Nicholson failed to timely object to a settlement agreement...
