On November 17, 2010, this court conducted a continued hearing on plaintiff Dwight G. Landon's motion to remand and defendant Monterey County Bank's motion for relief from the automatic stay. All appearances were made on the record. As stated during that hearing and for the reasons summarized below, the court grants Landon's motion to remand and denies Monterey County Bank's motion for relief from stay.
