OAKLAND (KRON) — An Oakland High School student who was dumped out of his wheelchair by a campus security guard has filed a lawsuit against the school district.

Surveillance video from the school shows security guard Marchell Mitchell cuffing and punching 18-year-old Francisco Martinez in May 2014. Martinez has cerebral palsy and uses a wheelchair.

In his lawsuit, Martinez says he was wrongfully detained.

Mitchel was telling students to get to class wen he got into an argument with Martinez.

Following the incident, Mitchell was fired from his job.

The lawsuit seeks unspecified damages.

Among the named defendants are the Oakland Unified School District, Oakland schools police, Mitchell, and former interim Superintendent Gary Yee.
