Sheboygan man allegedly assaults disabled victim

A 66-year-old Sheboygan man was charged with second degree sexual assault involving a mentally deficient victim.

Roberto Figueroa faces felony charges for alleged intercourse with a 31-year-old woman who, because of “development delays,” is not able to give consent, according to a criminal complaint filed Thursday, July 23, in Sheboygan County Circuit Court.

According to the criminal complaint:

The woman requires guardian permission before going anywhere with anyone. She speaks with her mother every day on the phone, who told a Sheboygan police officer she became suspicious when her daughter did not answer her calls, told her she was at “Roberta’s” apartment and then when the mother tried calling back, her daughter’s phone was turned off, which the daughter is unable to do on her own.

To a neighbor, the daughter confided she was “afraid of [Figueroa].” She told her neighbor that he would follow her and not leave her alone when she asked him to. The neighbor told officers Figueroa seemed to have a “sick obsession” with the woman.

After he was read his Miranda rights, he told officers he was innocent, but went on to acknowledge he would spend time with the woman, despite his knowledge of her condition.

Figueroa told officers that the woman “looked like she had something wrong.” He told officers he was trying to, “improve the woman hiding within her.”

If convicted, Figueroa could face up to 25 years initial confinement and $100,000 in fines.
