Man who punched, killed man with Asperger’s will not serve more than 4 1/2 years in prison, despite appeal

The sentence given to a London man on charges of manslaughter for sucker punching a man with Asperger’s syndrome will not be extended, reports say.

The attorney general sought a tougher sentence for 21-year-old Lewis Gill, who pleaded guilty to the charge of manslaughter in February after he was caught on surveillance video punching Andrew Young, 40.

The sentence of 4 1/2 years in prison was described as “an absolute joke,” by Pamela Young, the victim’s mother. She expected at least seven or eight years in prison, according to The Sun newspaper.

A trio of judges reviewed the sentence at the Court of Appeal and concluded it would not change because the sentence was not “unduly lenient,” said Lord Justice Treacy, even though the case inspired the public’s concern over the death.

The assault was prefaced by an argument over a bicyclist riding on the sidewalk during a November 2013. The bicyclist’s very buff buddy, Gill, punched Young in the face and knocked him to the ground.

The family of Young said he had the social skills of a 14-year-old and was very keen on bicycle safety, prior reports show.

Young fractured his skull when he hit his head on the pavement. He died at a hospital the next day.
