OPINION

ACREE, Chief Judge.

James and Sandra Fuqua appeal from the Daviess Circuit Court's order dismissing their claim with prejudice. They do not contend that dismissal was inappropriate, but argue only that it should have been entered without prejudice. We affirm in part, reverse in part, and remand.
