Grand jury indicts 23-year-old man in homicide outside Portland's Fontaine Bleau nightclub

A Multnomah County grand jury has returned an indictment against Xavier Dorrell Bolden in the fatal shooting last November of 30-year-old Durieul Joseph Harris outside the Fontaine Bleau Nightclub in Northeast Portland.

The 13-count indictment charges Bolden, 23, with one count of murder with a firearm, six counts of attempted aggravated murder with a firearm, four counts of unlawful use of a firearm, and one count each of first-degree assault with a firearm and second-degree assault with a firearm.

In recent weeks, Harris' relatives have made public pleas for information in the killing, disturbed that Harris' violent death had gone unsolved for months despite the presence of dozens of witnesses at the time of the shooting.

At 12:45 a.m. on Nov. 9, North Precinct and gang enforcement officers responded to the report of a large fight and riot outside the Fontaine Bleau Nightclub, 237 N.E. Broadway.

Officers arrived to find a crowd of 75 to 100 people involved in a disturbance.

As more than 100 customers filed out of the club, gunfire erupted in the street.

Several bullets struck Harris. He died 15 feet from the club's front door.

Officers learned that two other people, Sheila Shelby, 50, and Fredrick Conner, 44, suffered non-life-threatening gunshot wounds during the disturbance.

The shooting occurred after the club owner decided to shut down the venue after two men had been arguing in the restroom sometime after midnight. Harris may have tried to get between the two men fighting, investigators said.  

The grand jury returned the indictment Friday. Fifteen people, including Portland police, testified before the grand jury, according to the indictment.

The indictment accuses Bolden of killing Harris and then attempting to kill Shelby, Conner and a third person at the club. He tried to kill the others to conceal his identity in the death of Harris, the indictment alleges.

Bolden is not in custody. A warrant has been issued for his arrest.

Bolden, of North Portland, was arrested July 25 on unrelated drug charges. He was released from custody at the Multnomah County Detention Center the next day, as the charges were pending.

On Aug. 8, he pleaded not guilty to an indictment stemming from the July arrest charging him with possession of cocaine, delivery of cocaine and delivery of cocaine within 1,000 feet of a school, according to court records.

When he was arrested in August, Bolden reported to court authorities that he used cocaine five days a week and marijuana daily, according to court records. He said he had done work for a temporary job agency but had no job at the time of his arrest.
