This motion is decided in accordance with the annexed memorandum decision dated October 25, 2013.

In this asbestos personal injury action, defendant Union Pacific Railroad Company ("Union Pacific") moves to dismiss the complaint pursuant to CPLR 3271 on the ground that New York is an inconvenient forum. As more fully set forth below, the motion is denied.
