Settlement in disabled man’s homicide at NY facility

ALBANY, N.Y. (AP) >> Court papers show New York settling a federal lawsuit against staff at a state residence where a 33-year-old disabled man was killed three years ago when he was restrained.

The New York City medical examiner ruled Rasheen Rose’s death a homicide.

Staff at Fineson Developmental Center have denied wrongdoing, saying they acted within their professional judgment.

The suit by Rose’s sister, Sheniece Luke, sought unspecified punitive and other damages. It alleges that at least three staff threw Rose to the ground and one sat on him, while other staff stood by.

The assistant state attorney general representing eight staff tells U.S. District Judge Sandra Townes in a letter that the settlement in principle will resolve both this lawsuit and another in the state Court of Claims.

Terms were not immediately disclosed.
