New Hampshire Regulators Side With Morgan Drexen; Consumers Benefit

State becomes latest to affirm company's business model

State regulators in New Hampshire have determined Morgan Drexen Integrated Systems (http://www.morgandrexen.com) is not required to carry a separate license in its role as an independent provider of back-office support services to New Hampshire attorneys. The New Hampshire Department of Banking appraised Morgan Drexen's business model, which is predicated on a written agreement between Morgan Drexen and attorneys admitted to practice law in New Hampshire. The agreement stipulates that Morgan Drexen provide outsourced paraprofessional and paralegal law firm support for and under the supervision of those attorneys -- in this case Michael Fisher and Jeffrey J. Weiss.

In 2012, the Ethics Commission of the American Bar Association examined and approved the emerging practice of attorneys “outsourcing” paralegal and administrative services. The New Hampshire regulators determined this now well-established outsourcing model, applied to debt adjusting services, exempts Morgan Drexen from having to be licensed when working for attorneys who engage in the business of debt adjustment.

    “The New Hampshire Department of Banking's decision clears the way for New Hampshire residents to receive quality legal assistance from attorneys who rely on the efficiencies delivered by Morgan Drexen,” said Walter Ledda, Morgan Drexen CEO. “As with the recent decision in Colorado, we are pleased that our focused approach to providing cost and time-saving services to attorneys has been reaffirmed.”

    In September, 2012, a Colorado District Court ruled in favor of Morgan Drexen, as well as attorneys Drew Moore and Lawrence Williamson, in a case (#11CV7027) that also centered on Morgan Drexen's role as an outside provider of legal support services. New Hampshire attorney Michael Fisher says this latest pronouncement from the New Hampshire Department of Banking will have far-reaching benefits for consumers in his state.
