Before this court is Defendant's Motion for Summary Judgment Dismissing the Complaint [Dkt. No. 34] and Motion Requesting Entry of Order [Dkt. No. 40]; and Trustee's Opposition to the Motion Requesting Summary Judgment [Dkt. No. 42]. For the reasons set forth below, the Defendant's Motion for Summary Judgment is DENIED.
